Terms of Service

1. Agreement to Terms

By using aspiredwebsites.com or engaging Aspired Websites LLC ("we," "us," or "our") for any services, you ("you," the "client") agree to these Terms of Service. If you do not agree, please do not use our website or services.

2. Services

Aspired Websites LLC provides:

• Custom website design and development
• Website hosting and security
• Website maintenance plans (the Full Plan, billed monthly)
• Automated review generation (included in the Full Plan)

Service details, deliverables, and timelines are specified in the individual project agreement or invoice you receive at the start of a project. The specific terms of that agreement take precedence over the general terms here when they conflict.

3. Payment Terms

• Website builds: paid either in full at signing, or in 24 monthly installments with the first installment charged at signing. On the installment option, Aspired Websites LLC retains ownership of the website until the build is paid in full; the site remains live and in service throughout.
• Full Plan and Hosting + Security: billed monthly via Stripe from the day you sign, auto-renewing on the same date each month. Both are month-to-month; either party may cancel with 30 days’ written notice. Every recurring plan is billed monthly.
• Out-of-scope work: billed hourly, quoted in writing and approved by you before work starts, and invoiced after it is completed.
• Late payments: may result in service suspension after 14 days. We will always contact you before any suspension takes effect.
• 30-day guarantee: within 30 days of signing your agreement you may cancel a website build for any reason. We refund 75% of all amounts you have paid under the agreement, retain 25% for work already performed, and cancel any remaining installments or subscriptions. After 30 days, fees are non-refundable once work has begun, except as required by law, and our fix-it commitment applies. See the Refund Policy.

4. Project Terms

• Client provides content (text, images, logos, brand assets) unless the project agreement includes copywriting; the cost of writing copy is discussed before the agreement is signed.
• Projects include 2 rounds of revisions. Additional revisions are billed at our standard hourly rate, quoted in writing before the work starts.
• Client must provide timely feedback. Projects delayed more than 30 days due to client non-response may incur a restart fee equal to 25% of the original project price.
• Final files are delivered when the build is paid in full. On the installment option the site is live and in service before then.

5. Intellectual Property

• Once the build is paid in full, the client owns the website design, code, and content created specifically for them. The client’s domain is registered in the client’s name at all times.
• Aspired Websites LLC retains the right to display completed work in our portfolio, case studies, and marketing materials, unless the client requests in writing that we not do so.
• Client is responsible for ensuring they have the rights to any content (text, images, fonts, etc.) they provide to us. We are not liable for copyright or trademark infringement claims arising from client-supplied materials.
• Third-party software, fonts, plugins, or libraries used in your site remain subject to their own licenses.

6. Hosting and Maintenance

• Hosting is provided on DigitalOcean infrastructure.
• We target 99.9% uptime, but uptime is not guaranteed. Downtime caused by third-party providers, DNS issues, force majeure events, or client-requested changes is excluded from this target.
• The Full Plan covers hosting, ongoing updates, security patches, unlimited routine content updates (text, photos, hours, service areas, promotions), a monthly security report, and automated review generation. Hosting + Security covers hosting, server and application security updates, SSL renewal, and the monthly security report; it does not include content edits. Neither covers redesigns, new pages built from scratch, or new functionality; those are quoted separately at our hourly rate.
• Either party may cancel the Full Plan or Hosting + Security with 30 days’ written notice.
• Upon cancellation, once the build is paid in full, the client receives all website files and database exports free of charge and is free to host elsewhere. Hands-on migration help is billed hourly.

7. Limitation of Liability

To the maximum extent permitted by law, Aspired Websites LLC is not liable for:

• Loss of business, revenue, or profits due to website downtime, performance issues, or any other cause.
• Data loss beyond what our reasonable backup procedures can recover.
• Outages or failures of third-party services (hosting provider, payment processors, email delivery, DNS, etc.).
• Any indirect, incidental, special, consequential, or punitive damages.

Our total cumulative liability for any claim related to our services is limited to the amount you paid us in the 3 months immediately preceding the claim.

8. Confidentiality

We treat all client information as confidential and do not share it with third parties except as necessary to provide services (see our Privacy Policy for details). This obligation survives termination of the engagement.

9. Termination

We reserve the right to terminate services for non-payment, breach of these terms, or conduct that creates legal or reputational risk for us. We will provide written notice and a reasonable opportunity to cure when practical. Upon termination, any work completed and any data we hold for you will be delivered to you within 30 days, subject to payment of any outstanding invoices.

10. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in the State of Georgia, and you consent to that jurisdiction.

11. Changes to Terms

We may update these Terms from time to time. Active clients will receive at least 30 days written notice before material changes take effect. Continued use of our services after the effective date constitutes acceptance of the updated Terms.

12. Text Message Communications

If you provide your phone number to us — through our contact form, our chat widget, or during a project — you consent to receive operational and informational text messages from Aspired Websites LLC related to our services. This includes things like appointment confirmations and reminders, project status updates, and replies to a chat conversation you started with us. These messages are transactional, not marketing or promotional, and sending them does not require a separate marketing opt-in.
